By commissioning me in any kind of way, you are agreeing to the terms of service below.I. GENERAL TERMS
• My work is digital and digital only. I am not required to ship any physical goods.
• Provide neat references. Not a wall of text.
• All work is for personal or private use only unless agreed upon by both parties.
• As the artist, I maintain all rights to my work and I may use it for my needs such as portfolios, unless discussed otherwise by both parties.
• Credit is not required but it's highly appreciated
• I have the right to decline commissions that I feel I cannot properly execute.
• No one is allowed to use my artwork as a NFT (Non Fungible Token). My commissioned and pre-existing work, cannot be minted into an NFT by commissioner nor anyone else.
• If you fail to follow the rules provided I have the right to decline your commission.
FURTHER TERMS
• Turn around time may take up to 1 month or more after payment to finish depending on your slot number.
• After a commission is finished, only small changes are allowed to be made. Such as small coloring/marking mistakes.
PREFERENCES
• I feel comfortable drawing both female and male characters.
• Bust ups.
I DON'T DRAW
• Mecha
• NSFW
• Furries
• Very muscular characters
• Old characters
• And I'll not draw in other artist's style.
II. PAYMENT
• Full payment is required before I begin the commission. If your slot is high, you may request to delay payment until I am closer to your slot.
• Please be advised that the price may vary depending on the level of complexity of the order.
III. CANCELING/REFUNDING POLICY
• I have the right to cancel and refund the money of your commission at any time.
• You have no right to cancel or demand a refund from the artist under any circumstances after payment are received. So remember this and think carefully before commissioning.
• If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers; You will be forbidden to ever commission me, Diene, ever again; Your name will be publicly posted everywhere I want to for others to watch out for.
• I also have every right to file a complaint and I have all the right to the money you have given me.
IV. PROCESS
> After I accept the order, we'll proceed with the payment (an invoice will be sent) and the sketch will be made. Once you're satisfied, I'll work on finishing the drawing. Progress updates will be given to the commissioner if asked - maximum of 3 updates per week.
• Completion time for a commission will typically be between 1-4 weeks.
However, it can change depending on many factors such as Health, Order of commission, Complexity, Work, School, or Family Issues. Keep in mind that my process isn't that fast and and I have other personal matters to resolve too.
V. COPYRIGHT / USAGE POLICY
• I, the artist, hold every right to the produced drawing as much as the commissioner.
• Therefore I'm allowed to use the copyrighted artwork to:
ﾠ▸Promote myself within any place or site.
ﾠ▸Publish books with.
ﾠ▸To display it anywhere to my liking.
ﾠ▸Post it wherever I want.
• The commissioner is allowed to:
ﾠ▸Use the copyrighted artwork for personal use only unless agreed otherwise.
ﾠ▸Print the art, and claim the right of their character(s) but not the drawing itself.
ﾠ▸Use the art to promote themselves with proper credit given to the artist.
• If you break the copyright infringement in any way, every right you had to the drawing will be retracted.
• The following is considered Copyright infringement:
ﾠ▸Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way - with the exception of Twitch Emotes and Badges).
ﾠ▸Taking Credit for the creation of the artwork.
ﾠ▸Removing any watermarks/signatures.
ﾠ▸Altering the artwork without my, the artist's, consent.
• A Purchase of Commercial rights to the artwork will always be 100% of original price (not necessary with Emotes and Badges).
• With commercial rights you are allowed to make any sort of merch with the artwork; Use it in books, covers, as Props, change it to your liking and promote your own brand with.
